What’s the Difference Between a Witness Statement and a Position Statement?

Witness Statement (WS)
Required when ordered by the court — typically for fact-finding or final hearings. It’s a detailed, factual account, backed up by exhibits, and always included in the court bundle.

Position Statement (PS)
Used at any hearing where a WS hasn’t been requested. It outlines the key issues, your proposals, and any relevant references. While it’s not compulsory, most judges expect to see one.

Rule of thumb:

  • If the court has ordered a WS, make it count — and include exhibits.

  • If not, a sharp PS on the judge’s desk helps steer the hearing your way.
